This Privacy Policy describes how LiliBot, operated by AiGentsy ("we", "us", "our"), collects, uses, discloses, and protects your personal information when you use our website, services, and applications (collectively, the "Service").

By accessing or using the Service, you agree to this Privacy Policy. If you do not agree, please do not use the Service.

1.1 Information You Provide Directly

  • Account Information: When you create an account through our authentication provider (Clerk), we may collect your email address, name, and profile information you choose to provide.
  • Payment Information: When you subscribe to LiliBot Premium, payment processing is handled entirely by Paddle (our Merchant of Record). We do not store, process, or have access to your full credit card numbers, bank account details, or other sensitive payment credentials.
  • Communications: If you contact us via email or other channels, we retain those communications to respond to your inquiries and improve our Service.

1.2 Information Collected Automatically

  • Usage Data: We collect information about how you interact with the Service, including pages visited, features used, time spent, and navigation patterns.
  • Device Information: We collect device type, operating system, browser type, browser version, and screen resolution.
  • Log Data: Our servers automatically record information including your IP address, access times, referring URLs, and error logs.
  • Cookies and Similar Technologies: We use cookies, local storage, and similar technologies to maintain sessions, remember preferences, and analyze usage. See Section 6 for details.

1.3 Information from Third Parties

  • Authentication Providers: If you sign in using a third-party service (e.g., Google, GitHub via Clerk), we receive limited profile information as permitted by that service.
  • Payment Processor: Paddle may share transaction confirmations, subscription status, and limited billing information necessary for service delivery.

2. How We Use Your Information

We use collected information for the following purposes:

  • Service Delivery: To provide, maintain, and improve the Service, including account management and subscription fulfillment.
  • Authentication & Security: To verify your identity, protect against fraud, and ensure the security of your account and our systems.
  • Communication: To send transactional emails (account confirmations, subscription updates, security alerts) and respond to your inquiries.
  • Analytics & Improvement: To understand usage patterns, diagnose technical issues, and improve Service functionality and user experience.
  • Legal Compliance: To comply with applicable laws, regulations, legal processes, or governmental requests.
  • Enforcement: To enforce our Terms of Service and protect our rights, property, and safety, and that of our users.

3. Information Sharing and Disclosure

✓ We do NOT sell, rent, or trade your personal information to third parties for marketing purposes.

  • Service Providers: We share information with third-party vendors who perform services on our behalf, including:
    • Clerk – Authentication and user management
    • Paddle – Payment processing and subscription management (Merchant of Record)
    • Vercel – Website hosting and edge delivery
    • Analytics providers – Anonymized usage analytics

    These providers are contractually obligated to protect your data and use it only for the services they provide to us.

  • Legal Requirements: We may disclose information if required by law, subpoena, court order, or other legal process, or if we believe disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
  • Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change and any choices you may have.
  • With Your Consent: We may share information for other purposes if you provide explicit consent.

4. Data Security

We implement industry-standard technical and organizational security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These include:

  • Secure authentication through Clerk with support for multi-factor authentication

  • Right to Opt-Out of Sale/Sharing: We do NOT sell or share your personal information for cross-context behavioral advertising.

Notice at Collection: We collect categories of personal information as described in Section 1 for the purposes described in Section 2. We retain this information as described in Section 5.

9. International Users & GDPR

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have rights under the General Data Protection Regulation (GDPR) and similar laws:

  • Legal Basis: We process your data based on: (a) your consent, (b) performance of a contract, (c) our legitimate interests, or (d) compliance with legal obligations.

The Service is not intended for children under the age of 18. We do not knowingly collect personal information from children under 18. The Service may contain links to third-party websites, services, or applications. We are not responsible for the privacy practices of these third parties. We encourage you to review the privacy policies of any third-party services you access through our Service.

This includes but is not limited to: social media platforms (X/Twitter, Discord, Telegram), payment processors (Paddle, Ko-fi, Coinbase Commerce), and authentication providers (Google, GitHub).

12. Do Not Track Signals

Some browsers include a "Do Not Track" (DNT) feature that signals to websites that you do not want your online activity tracked. There is no uniform standard for interpreting DNT signals. Currently, the Service does not respond to DNT signals, but we do not engage in cross-site tracking for advertising purposes.

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on this page with a revised "Last updated" date. For significant changes, we may also send you an email notification.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

16. Indemnification

You agree to defend, indemnify, and hold harmless LiliBot, AiGentsy, and their officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of this Privacy Policy or your use of the Service.

17. Governing Law and Dispute Resolution

This Privacy Policy shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with this Privacy Policy shall be subject to the exclusive jurisdiction of the state and federal courts located in California.

18. Severability

If any provision of this Privacy Policy is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
